Why You Need an LPA

None of us know what the future holds. An accident, sudden illness, or conditions like dementia can leave you unable to manage your own affairs. Without an LPA in place, even your spouse or closest family members have no automatic legal right to act on your behalf — meaning decisions about your finances, property, and care could be made by strangers or delayed by the Court of Protection.

The Two Types of LPA

You can create two separate LPAs, each covering different aspects of your life:

Property & Financial Affairs LPA. This gives your attorneys authority to manage your bank accounts, pay bills, sell property, handle investments, and deal with pensions. It can be used as soon as it’s registered, or only if you lose capacity — the choice is yours.

Health & Welfare LPA. This covers decisions about your medical treatment, care arrangements, and where you live. It can only be used once you lack the mental capacity to make these decisions yourself. Your attorneys can also make choices about life-sustaining treatment if you’ve given them that authority.
